What the tools can and cannot see

Both tools work from four inputs: age, length of service, occupation, and jurisdiction. They have no knowledge of the many other matters that affect an award of reasonable notice, including:

  • the availability of comparable alternative employment;
  • the manner of dismissal, and any bad faith conduct;
  • whether the employee mitigated their losses;
  • whether the employee was induced or recruited away from secure employment;
  • the terms of any employment agreement — in particular, an enforceable termination clause may displace common law reasonable notice entirely, in which case the figures shown here will not apply;
  • applicable employment standards legislation, which sets minimum entitlements.

Estimates are not outcomes

The Bardal Index reports what courts awarded in past cases. Past awards are not a guarantee of future results. BardalGPT produces a statistical estimate with an average error of approximately 2.4 months; individual cases fall further from the estimate, and the stated ranges are probabilities rather than promises. Neither tool predicts the outcome of any particular case.

The underlying database is compiled from reported decisions and may contain errors or omissions. It covers reported decisions only; the great majority of employment disputes settle privately and never appear in any database. No warranty is given as to the accuracy, completeness, or currency of the information on this site.

Jurisdiction

This site addresses the common law of reasonable notice as applied in Canadian jurisdictions other than Quebec. It does not address Quebec civil law, federally regulated unjust dismissal provisions, unionised employment governed by a collective agreement, or the law of any other country.
